To all property owners in New Zealand A heads-up from Mangawhai in the Kaipara District , 110 kms north of Auckland. At 10.00am on Friday 18 July the High court, sitting in Christchurch will hear final submissions from counsel in a judicial review hearing that is of fundamental importance to every person who owns or rents property in New Zealand. At issue is whether councils can illegally raise money and then set rates to force repayment of the debt out of ratepayers’ pockets. Ever since 2002 councils that have acted illegally have simply drawn themselves up local bills, taken them to parliament and got the government to allow them to get away with it. Kaipara District Council ( now under the reign of governmment-appointed commissioners ) has borrowed just under NZ$60,000,000 illegally to fund the reticulation of Mangawhais sewerage scheme -which was initially costed at around $12,000,000. The Mangawhai Ratepayers and Residents Association challenged the illegal borrowing in court and WHILE the matter was in front of the court, the government, aided by the Greens Labour, and the Maori Party, legitimised the illegal behaviour retrospectively by passing the Kaipara District Council Rates and Other Matters Act ( 2nd of December 2013 ) If the court condones this act, it will mean that any council, anywhere in the country can simply decide behind closed doors to spend any amount of money on anything they choose, and the ratepayers will have to foot the bill. If the court finds that Councils can act illegally and bill the ratepayers it will no longer even be necessary for Councils to get their criminal acts validated by Parliament. They will simply be able to point to the judgment of the High Court - which has set the legal precedent - and give their ratepayers the one finger salute.... There is more at stake in the High Court tomorrow than there is at the general election in September. Be warned, everyone, democracy and human rights are on trial in the High Court and the wrong decision could see everyone who owns or rents property in New Zealand turned into serfs and vassals of the banks overnight.
