To all those who ride in West Virginia. Please share your encounters with local law enforcement. I was riding on Sept 28 2014 heading from Maitland/mount view area going towards welch. My intended route was to ride the shoulder of us 52 through town to the sterling drive in. As I was going into to town (as much as I could) I was on the shoulder of the rd. I go across the bridge at the municipal building no problems. As soon as I turned right to go up towards the court house/magistrate office I was pull over about 80feet or so on an unlined road. I was charged with atv on roadway and driving on revoked. According to chapter 17f-1-7 of the wv atv code a valid drivers license IS NOT required to operate an atv in wv. In this chapter of 17F-1-7 it states that ATVs can only be operated on the road/highway(non interstate)if they are crossing the road or going from one trail head to another at speeds less then 25mph for no more then 10 miles. It also states that ATVs can be operated on the shoulder of the road If you have had this happened to you or someone you know please share. Please share the out come of what happened.
