To the Honorable Members of the Clay County Commission Subject: Emergency Meeting At your last meeting 3 members of this board voted to break the law. What should have happened is nothing more than you should have reviewed the School Board Resolution for legal form and then forwarded it to be placed on the ballot. After you had accomplished this clear legal duty, those for or against the resolution could have advocated their positions and everyone could have voted on it in a democratic fashion. Instead, you voted to break the law. You do not have to admit that you were wrong. You can continue to hold your opinions but claim that the county budget deficit and proposed tax raise make the cost of a legal defense fiscally irresponsible, which it is. To the Commissioners who voted for this illegal action: Commissioner Robinson, if you continue on this course it will cost the taxpayers a lot of money and this item will go on the ballot anyway. To Commissioner Hutchings, as the newest member of the Commission it is possible you made an inexperienced decision, you should reconsider. Commissioner Stewart, you cannot claim inexperience. Your vote lends itself to obvious speculation of influence by outside parties. I would like to avoid collateral damage but I am not going to stand by silently and allow a government body to break the law. If you wish to continue on this course, ask yourself, would a judge accept the reasons you gave on public record to explain your breaking the law? Would a judge spend one minute listening to the Advanced Ed representative and consider that as relevant? Would a judge accept that the County Charter takes precedent over the state statutes in establishing timeliness? Would a judge buy the notion that in 2008 it caused public confusion to vote for the At-large while voting to eliminate the At-large, so to avoid confusion the public should vote in 2016 for the Superintendent while voting to eliminate the Superintendent? You should follow your attorney’s advice, because you will not find an honest attorney that agrees with you.
