Today, commercial surrogracy is a boom in india. People from all over the world gets attracted for the ample of reasons such as commercial surrogacy is legal in india, which is not so in many countries, medical infrastructure is appropriate, potential surrogates, low cost, etc. With the increase in surrogracy, assisted reproductive tech bill was the result to govern it. But it is still in the nascent stage and yet to see the light of the day. Due to any appropriate act regulating it, surrogate mothers are at disvadvantaged end for the following reasons 1. They have been considered as the baby delivery machine and no check on the health of the mother. 2. Due to lack of awareness, they are being forced into this trade for the money thing. 3. Since, many a times they are left with the baby due to the gender reason. Recent changes have been made to make the bit safer and also protect them from various discrimination. This is done so as to protect the child from discrimination as in many countries it is not legal and the child may not be given citizenship and due benefits. Foreign nationals and single parents have been barred from using this service. But there has been a debate regarding it. Indian law, indian juvenile act allows the same. Also, it would be a breach of article 21. Thus, ART act should be passed so as to provide a conducive environemnt for the surrogates otherwise they will be at the disadvantaged end Ctsy Ankit Tanwar
