Today in NYC, fast food workers are scheduled to go on strike. Everyone knows these working people are paid poverty wages for an honest days work. They are striking for higher wages. The striking workers have said that they plan to use civil disobedience to make their voices heard. Arrests and prosecution for freedom of speech can violate a person’s civil rights. The proposition that the First Amendment prohibits official reprisal for protected speech extends to criminal prosecutions brought to punish an individuals constitutionally protected speech, Hartman v Moore, 547 US 250, 126 SCt 1695. The police cannot arrest a person when they lack probable cause to believe that crime is afoot. They cannot prosecute someone for expressing themselves. RMKinjurylaw Share if you support.
