Todays Lesson: MOST affronts to the 4th Amendment by the government occurring at a private residence do not involve a Search Warrant at all. They use a technique they call a Knock and Talk (more like Knock and Intimidate) where they basically get an occupant to open a door and then exploit the opportunity to big-ass their way in and call it Consent. (Why people open the door for people they dont know in the first place totally escapes me? Didnt their mothers teach them Dont talk to strangers?) Whats it take to get them there? Anything! Often a call from a mad or suspicious anybody. So okay, theyve screwed up and opened it. What to do now? Occupant: Yes? Government: Im Detective Buzzkill from the Narcotics Task Force, this is Detective Hammeryou. Weve had a report of Narcotics Activity at this location and --- Occupant: (Interrupting) Oh, do you have a warrant? Government: Well, no.
