Todays story on CBC about Capital One (bank) putting liens on 3 different properties in Calgary owned by a man with the same name (yes, all different people) is an example of banks being pandered to by the courts. How can the courts continue to offer the right to lien someones property at a whim ? One person may owe a credit card funds and deserve action from the credit card company. It is obvious, I would think, that the request to the courts for the order for 3 different liens is an opportunity for the Judge to push back . . . dear bank: Identify your client and then, and only then will I offer an order to lien your clients home. Id love to understand why the court houses just act BLINDLY in home liens with no burden of proof offered by the plaintiff.
