Tomorrow 9th Circuit Court of Appeals will hear arguments whether Hawaiis Federal case for marriage equality should be mooted due to the legislative passage of marriage equality last year. Marriage equality opponents want the case mooted and thrown out (for obvious reasons). But here is a great irony: opponents are also actively challenging the validity of the statute in a separate case. Ergo, the case about whether gays should be able to marry is NOT moot, but STILL an active legal controversy--thanks to opponents themselves. They are essentially arguing settled law in one court while working to challenge that law in another court.
