Tomorrow, CCR attorneys will be in Philadelphia urging the Third Circuit Court of Appeals to reverse a February 2014 district court decision dismissing our case challenging the NYPD’s blanket surveillance of Muslim communities in New Jersey. The plaintiffs in Hassan v. City of New York, originally filed by Muslim Advocates and joined by CCR in 2012, are a broad group of American Muslims from diverse backgrounds, including a decorated Iraq war veteran and the former principal of a grade school for Muslim girls. Since 2002, the NYPD has spied on a huge range of Muslim-affiliated civic, business, and religious organizations across New Jersey, including the mosques, retailers, grade schools, and college-campus Muslim student associations that form the heart of our case. Outrageously, the district court’s ruling dismissing the case justified surveillance on all Muslims based on their religion and opined that any harm arising from the NYPD’s spying was not the result of the spying itself, but of Pulitzer Prize-winning reporting by the Associated Press revealing the secret practice. Judge William Martini also said the “[NYPD] could not have monitored New Jersey for Muslim terrorist activities without monitoring the Muslim community itself.” Not a single lead on criminal activity has resulted from the extensive spying program.
