Tomorrow’s status conference on President Kenyattas ICC trial will discuss Kenyas cooperation with the court following the prosecution’s application for a finding that the state failed to comply with its obligations under the Rome Statute. In an annex related to its 31 January filing, the #ICC prosecution alleges that “a climate of fear” has engulfed the Kenya ICC cases and hampered the prosecutions investigations. Among other concerns, the document claims that Kenya has: 1) Failed to facilitate the prosecution’s access to persons of interest in Kenyas territory, with particular reference to police officers. 2) Failed to provide the prosecution with complete, unhindered access to documentation, with particular reference to President Kenyattas financial records, mobile telephone data of persons of interest and government security documents related to the PEV period.
