Tonight I attended a great free Legal 101 for Musicians Seminar sponsored by MusiCares at the Grammy offices tonight. The two speakers dispensed some excellent info about the fundamentals of copyright, publishing, monetization as it relates to YouTube, distributors, aggregators, mechanical royalties, public performance rights organizations and the term synchronization and how that relates royalty-wise to video and accompanying music. A few days ago I thought to myself I wonder if a drum solo might ever be used as the primary or only music in a TV commercial and after the seminar I was pondering how might a drum solo be subject to royalties and synchronization if used in said advert. Lo and behold Im just now watching a TV commercial for a brand of whiskey and the ONLY music in it is Max Roach playing his famous Mop Mop drum solo that he composed as inspiration from and to honor Big Sid Catlett!! Wow!! Granted it was sped up a bit as well as edited and EQed to suit modern tastes but Im pretty darn sure it was Maxs phrasing and touch. I was so surprised that I kept rewinding it and listened to the commercial 3 times in a row. I really hope Max Roachs estate got some great compensation for that commercial.
