Tonight, as I was eating my dinner, I was flipping between the Cardinals/Dogers game & the Cavato show where Charles Payne was filling in for Neal. He made two absurd comments: (1) that Obama was a constitutional scholar (Obama was only an adjunct instructor on the Constitution who, as the semesters went by, received increasingly poor marks for his teaching, which hardly qualifies as being a scholar); and (2) asked why the President didnt give greater consideration to relying on the 14th amendment to bypass congress and raise the debt ceiling. I do wish conservative folks would learn more about the Constitution before making outrageous inferences such as the 14th amendment giving this president or any president such authority. (1) The 14th amendment was one of the three reconstruction amendments passed to ensure that the newly freed slaves would be guaranteed their equal rights as free Americans. (2) Section 4 was added to underscore the reunification of the southern states with the northern ones in that all of the states, including the southern ones, would have to chip in to repay the war debts of the northern states, but no state who was on either side of the conflict would be responsible for paying the war debts of the Confederacy. It is argued that because the the phrasing the public debt…including debts incurred… can possibly be extended beyond the debts incurred for the war between the states, from a historical context and from an originalist approach to the interpretation of the Constitution, that would be taking it beyond its intended purpose. (3) Regardless of whether you take the broad view of the matter of what debts are under consideration in section four or the narrow view that it was dealing with the war debts at that time, you must tie it to section five which states The Congress shall have power to enforce, by appropriate legislation, the provisions of this article. Hence, if Congress does not authorize an increase in the debt ceiling in order to pay our debts, then no president or court has any constitutional authority to do so outside of congressional approval. This is why we must have individuals in the Congress who not only read the bills they vote on, but also read on a regular basis the Constitution they take an oath to uphold and defend. My opponent, Congressman Barton, may have the years of experience in Congress that I do not have, but I can say confidently that I have the knowledge of our Constitution that the 6th district of Texas and the country needs in one who represents them.
