Topic spot - Police can’t help in case of dispute with registered agenciesThe Delhi police has no authority in cases of dispute involving maid placement agencies that are properly registered with the government. In case of disputes involving registered maid placement agencies, the police urges clients of the agency to move consumer forums to recover their dues or to settle the dispute, according to a senior police officer, who has investigated several cases involving fake maid placement agencies. Additional commissioner of the police, West Delhi, Ranvir Singh said that the illegal agency owners who dupe people on the pretext of providing them domestic help should be booked under various sections of the Human Trafficking Act. “The accused who run fake maid placement agencies keep the maids as hostages. They treat them like bonded labour,” Mr Singh said. He said that in his district the police had successfully rescued over 100 children who were brought from different regions on the pretext of providing them jobs. The accused mostly made the children to work as domestic help in posh areas of the city. “We also have taken action against the accused who run the fake maid placement agencies. In recent past, we arrested a few of them,” Mr Singh said. As per law, if the maid placement agency is registered with the government, the police cannot book the owners or their employees under Section 420 (cheating) of the IPC. “If a victim approaches the police against a placement agency, the police first tries to verify whether the placement agency is a registered firm. If the firm is registered and the accused has not changed phone numbers, then Section 420 of the IPC cannot be imposed. The firm has only withdrawn its service. Hence, an FIR can only be lodged if the firm is not registered,” the police officer said. The police involvement is not needed if the maid placement agency is registered and it only has not delivered its service as per promise. It is a civil suit in that case. “If a firm is not fulfilling its promise or not providing its service, an FIR cannot be lodged against it. Such cases are dealt at consumer forums,” the police officer explained. Vinod, a resident of Southwest Delhi’s Dabri area, said he had hired a maid from a local placement agency after reading an advertisement on a pamphlet. He paid Rs 22,000 in advance to the owner of the placement agency. A day later, his maid fled from the house. He contacted the owner, who assured him that another maid would be provided instead, but nothing happened. After being harassed, Vinod lodged a complaint with the local police and another with the crime branch. A few days later, a cop approached him and suggested that he should move the consumer forum.
