The request also clearly demonstrates that the Quebec government has never negotiated fairly on the issue of transfer of land at Kahnawake with the MRC de Roussillon, the City of Saint-Constant, the City of Sainte-Catherine, the City of Châteauguay and the municipality of Saint-Isidore. "The lands in question were removed to municipalities without any negotiation. As elected officials, we have a duty to enforce our rights and defend the interests of our people. We decided to act by placing a first step with the filing of this petition " , said Gilles Pepin, mayor of Saint-Constant. The petition filed by the MRC and cities also seeks annulment of condition number 3 of Government Decree, which provides that the rights exercised on land transferred are the same as within an Indian reservation. The plaintiffs believe that this requirement is unconstitutional and illegal and must be challenged because it attempts to allow land users to exclude their activities of general laws of Quebec.
