Trust responsibility is a strange thing to try and get the State and Feds to wield and recognize when it comes to protecting Tribal Homelands. There is one absolutely critical enactment that is under the discretionary authority of the EPA and its found in Section 404c of the Clean Water Act. (Think Bristol Bay and Pebble Mine). This section of the Clean Water Act is not a guarantee to stop mining but it is a guarantee to get objective scientists into the Bad River Watershed to put together true science and data sets that examine the web of life on a multitude of levels. I should probably mention that mining permitting process are stopped until true science is gathered by the Federal Regulators. This is good for those that are pro-life. We are on the cusp of a formalized initiative to get this process started at the Federal level. The enactment of 404c would be a tangible first step in the United States honoring of Treaties and the upholding of the responsibilities that come with trust responsibility. - with the Chippewa Federation
