Tusker Watch & Win Terms and Conditions The following terms and conditions apply exclusively to the aforementioned promotion and all participants in the promotion are deemed to have read, understood and accepted the same: 1. This promotion is restricted to persons over the age of eighteen (18) years. Proof of age will be required prior to redemption of any prize. 2. Employees of East African Breweries Ltd Group of companies (KBL, UDV, EAML, CGI, SBL, UBL) it’s distributors and stockists, Smart printers Ltd, Metal Crowns Ltd, Tanzania PrintersLtd, Pricewaterhouse Coopers Ltd, Interactive Media Services Limited, Saracen Media, Mediacom, Scanad, Exclamation Marketing, Royal Media Services and any other supplier or third party directly involved with the facilitation of this promotion and their immediate families are not eligible to participate in the promotion. 3. The promotion will run from 04 October 2013 to 08 December 2013. 4. Decisions made by Kenya Breweries Ltd shall be final and binding. Participation 5. To enter the promotion Participants will be required to purchase a 500ml Tusker lager promotional product and check under the crown to find a 6 character alpha numeric code. This code on its own is neither a lucky number nor does it guarantee a Participant anything in return. 6. During select airing of the Tusker Project Fame TV show on Citizen TV, The Presenter will reveal a 2 digit alphanumeric code. This code on its own is neither a lucky number nor does it guarantee a Participant anything in return. 7. To participate, Participants will be required to compose a text message (through SMS) starting with the 2 digit alphanumeric code aired on Citizen TV and which is valid for one (1) day,followed by the 6 digit alpha numeric code under the crown and send it to a mobile short code, number 21001. Each SMS sent will be charged at a rate of Kshs 5/- only for all mobilenetwork subscribers (Safaricom, Airtel, Orange & Yu) 8. In the event that a Participant composes a blank text message, a guessed code or mistypes the 2 digit alphanumeric code revealed on Citizen TV or the 6 digit alphanumeric code under the crown, the Participant will get a regret message either saying the 2 digit alphanumeric code or the 6 digit alphanumeric code under the crown is invalid. 9. In the event that a Participant composes a text message using either the 2 digit alphanumeric code revealed on Citizen TV or the 6 digit alphanumeric code under the crown that has already been sent to the short code for the competition, the Participant will get a regret message saying the code on cap has already been used. 10. In the event that a Participant composes a text message using either the 2 digit alphanumeric code revealed on Citizen TV or the 6 digit alphanumeric code under the crown before the show at 8.30pm on weekdays and 7.30pm on weekends, the Participant will get a regret message requesting them to watch the show and try again. Selection of Winners 11. Systems and controls around the selection of the winners have been validated by PricewaterhouseCoopers (PwC); an independent audit firm. 12. Winners will be selected by the order in which their messages arrive at the servers of the CSP (Integrated Media Services) in the presence of the BCLB, PwC & authorized KBL staffwhenever possible. 13. After selection of winners is done, the decisions made on the same including reward of cash prizes by Kenya Breweries Ltd (KBL), shall be final and binding. 14. The first correctly filled out text messages received at the servers of the designated short code 21001 will be rewarded at the sole discretion of KBL, with cash prizes of Kshs 500 or Kshs5,000 or Kshs 10,000 through Mpesa within 72 hours . 15. There will also be 16 weekly winners of Kshs 500,000 each and a jackpot winner of Kshs 2million. Winners of these prizes above Kshs 10,000 will be notified through a dedicated KBLhelpline 0723 999 555 within one hour of sending the winning entry and paid via cheque system within 7 working days. The winner will be required to travel to KBL offices in Ruaraka (as communicated by KBL) to collect the cheque and all related expenses will be borne by the winner. 16. Winners of the various prizes will be informed in accordance with the guidelines submitted to the Betting Controls Licensing Board (BCLB); and the decisions made on the same by KenyaBreweries Limited (KBL) and BCLB, in consultation with PricewaterhouseCoopers (PwC), shall be final and binding. 17. Prizes are redeemable in Kenya only and are not transferable and any non-cash prizes shall not be redeemable for cash. 18. The award of all winning prizes will be subject to the authentication of the identity of the selected winner through the following: -a. Presentation of proof of identification: original identification card/original passport; andb. Confirmation of winner details provided to KBL against Mpesa payment details. 19. Subject to any technical issues beyond KBL’s control the winners of all the cash prizes save for winners of cash prizes above Kshs. 10,000 will be sent their money via Safaricom’s Mpesaservice within 3 working days of receiving confirmation of their having been selected as winners. Notification of Cash Wins 20. Winners of cash during each show will have the cash transmitted within 72 hours through Safaricom’s Mpesa services. 21. KBL will not be liable for any delays brought about by both the mobile telephone networks & mobile money transfer systems. 22. Winners who are not registered with M-Pesa have to collect their cash from M-Pesa agents within the 7 days as stipulated by M-Pesa regulations. Failure to do so will lead them toforfeiting their prize. 23. KBL shall not accept liability where a winner for one reason or another cannot access their money once it has been sent to them e.g. where Safaricom has suspended the recipient’sM-pesa account, or if they are not accessible via M-pesa. 24. For cash prizes above Kshs 500,000 a Participant will be called to confirm their identity. If the call is not answered within 5 rings or the winners phone is off or the call is forwarded tovoice mail or a person other than the owner of the phone answers the call the prize will be deemed to have been forfeited and another winner selected based on the incoming order ofvalid entries. This Participant will however receive first priority in selecting winners of lower denomination prizes in a descending order. Use of Personal Data 26. By agreeing to participate in the promotion you are giving KBL permission to contact you for further information. 27. By agreeing to participate in the promotion, all winners of the prizes agree that their full names, photos, video footage and other details be made public in such media that KBL maychoose and that they will further agree to participate in all public relations and marketing activities of KBL on such terms, as KBL may require without any additional consideration. 28. All the ownership and intellectual property rights in the footage and visuals taken of any participant, his / her family and surrounding on lookers is and shall at all times remain the soleproperty of KBL. 29. Use of the materials stated above shall be at KBL’s discretion and KBL shall be entitled to disclose any of the participant’s details for administering the promotion, marketing and researchrelated activities, fraud prevention and such other purposes as may be provided in terms and conditions herein and the law. Disqualification and Termination 30. The promotion is offered at the sole discretion of KBL and KBL reserves the right, subject to any discretion from the BCLB, to amend or vary these terms and conditions or tosuspend/amend/terminate the promotion at any time. In case any of these circumstances arise, notice will be given by KBL through media advertisements. The notice will be effectiveimmediately or on such date as shall be set out in such notifications. 31. On termination of this promotion for any reason not attributable to the participants, the participants will be required to redeem their prizes within thirty (30) days after the termination date. 32. KBL reserves the right to terminate any participant’s participation in the promotion or their registration upon: -1. Detection of fraud or attempted fraud relating to the participant or their registration; or2. Breach of any of these terms and conditions; or3. Such circumstance as may be determined by KBL. 33. If participation in the promotion is terminated under any of the circumstances set out in clause 32 above, the participant will lose the right to redeem his/her prize and the same will bedeemed to have been forfeited. In addition, KBL reserves the right to take appropriate legal action, as it deems necessary, and recover damages and other expenses incurred in pursuingsuch action. Other Terms 34. This competition remains subject to the provisions of the Betting Lotteries and Gaming Act (Cap 131 Laws of Kenya) 1991, and all other applicable laws. Any disputes arising hereundershall in the first instance be resolved in accordance with the aforementioned provisions. 35. All queries should be directed to the customer care helpline number 0723 999 555; available from 8:00a.m to 9:00 pm. The same number will be used to contact winners. 36. KBL reserves the right to amend and adjust the promotion format and timings as it deems fit. 37. KBL reserves the right to amend the merchandise & cash prizes as it deems fit at any point in the promotion. 38. KBL DOES NOT require you to send money, airtime or M-pesa funds or any other consideration in order to participate or claim any prize in this promotion, and KBL will not be liable forany losses or other damage incurred by any person who does not heed this caution. 39. Although KBL has used reasonable efforts to ensure that all information and materials relating to the promotion are accurate, KBL shall not be liable for any inaccuracy or errors in suchinformation and/or material. KBL, its agents and sub-contractors will also not bear responsibility for any loss or damage to a participant, whether caused by self or any third party, arising from: -1. Matters outside the control of KBL, its agents and sub-contractors including but not limited to force majeure events such as acts of God, computer viruses, power outages, etc; -2. Any technical failure or malfunction or any other problem with any machine, telephone network or system, service provider software or otherwise which may result in missing charactersin the promotional packs, any entry being lost or not properly received, registered or recorded. -3. Any unforeseen defects in promotional materials supplied or manufactured by third parties including but not limited to labels and crowns. -4. Any acts of negligence by the Employees of KBL , Pricewaterhouse Coopers or BCLB or their agents , associates and assigns. 40. These terms and conditions are subject to interpretation by KBL and any questions or disputes shall be resolved by KBL and BCLB and the decisions reached thereafter shall be final.
