UPDATE: My apologies for not posting sooner... There will be No Civil Trial today in red bluff. On monday (oct. 21) Jayme & I were summoned to court to hear the das arguments as to why the civil trial should be continued.. Are you ready for this? okay here we go: The das argument? They want to wait until the BUTTE county case goes to trial (Nov. 25) to see if I am convicted there. If not, they will decide whether or not to re-file their case. In order for TEHAMA county to successfully initiate forfeiture proceedings on the 2002 ford explorer, they Must sustain a conviction on a Possession for Sales charge. Are you following this? TEHAMA county is trying to take a vehicle that was purchased in 2013, based on a conviction (which is yet to happen) on a charge for an offense that allegedly occurred in 2011, in a DIFFERENT (BUTTE) county. No, I am not making this up. TEHAMA county believes that they can steal whatever they want from someone (who is unfortunate enough to find themselves in tehama county), if that person has an open possession for sales charge, Any Where, Any Time in the last 5 years. The judge granted the continuance. We come back Dec. 9 to see if I have been convicted in BUTTE, or if not, to see if TEHAMA has then decided to RE-FILE charges against me. Again, I am Not making this up..I wouldnt believe it myself if I hadnt been in court on monday and werent looking at the stack of paperwork verifying this nonsensical claim. So there you have it. Asset Forfeiture=Strong Arm Robbery. In this case, carjacking. Actually, when they told me Get out of the car! it wasnt strong arm- they had guns and there were at least a half-dozen of them. I would have rather been carjacked in the city, at least I wouldnt being trying to make any sense of it. Just curious..is there something really special about a car that is over 10 years old, 150k plus miles? estimated value: 5k. seriously. maybe there is something I dont know about this particular vehicle.
