US CR-1/IR-1 Visa A U.S. citizen who is married to a Thai national may apply for a conditional resident (CR-1) visa or immediate relative (IR-1) visa for the Thai spouse. A CR-1 visa permits its recipient to conditionally reside upon arrival to US. The marriage between the U.S. citizen and the Thai spouse must be less than 2 years to qualify for the said visa application. The residence status is considered conditional. Hence, the conditional resident and the US citizen spouse must apply together to remove the conditional residence status. An IR-1 visa, on the other hand, is given to a spouse of a US citizen to permanently reside in the US. The marriage must be 2 years or more from the day of the application. Unlike a CR-1 visa, an IR-1 visa permits its holders to work immediately upon entering the US. The holders need not file anything to make the residency permanent. The application starts with the filing of an I-130 form with the US Citizenship and Immigration Services (USCIS).
