US SUPREME COURT SIDED with a defendant in a case previously argued by Rep. Rose Mary C. Robinson In other notable local litigation events reported in Crains: The U.S. Supreme Court sided with a criminal defendant in a case previously argued by Rep. Rose Mary C. Robinson, formerly a general counsel of the American Federation of State, County and Municipal Employees Council 25 and sometime criminal appellate attorney, elected to the state House of Representatives in November. At issue in People v. Lamar Evans was whether Evans, accused of arson of real property for a Detroit house fire, was protected by double jeopardy after a trial judge issued a directed verdict of acquittal. Some evidence suggested the owner of the house and his family had moved some family belongings in the house and may have been moving in, prompting the defense to argue the prosecution should have charged arson of a dwelling instead.
