Uhoh. This could be big. Indeed, if the main conspirator is Janet Napoles, it could not be plunder because she is a private person. A plausible defense of the senators for the plunder csses would be to say that all the allegations in the complaint shows that it is Napoles that initiated and carried out all of these and therefore they could not possibly be guilty of plunder. Very good lawyering by the Napoles lawyer which I am sure will now be exploited by the lawyers of the senators. I think this would have bearing in the preliminary legal skirmish on bail as the issues of whether plunder is an appropriate charge and evidence of guilt is strong will be tackled there.
