Uhuru has given Kenya, enough homework till he returns I.e discussing who is an acting president....???? There is a serious legal lacuna here. Can the President “decide” to appoint his Deputy for the remainder of his term? I think No since this was not the intention of the sovereign people of Kenya. Can this legal lacuna be sealed with legislation? This is debatable. Some could argue that any such legislation would be unconstitutional if it purports to curtail the powers of the President under Article 147(3). Perhaps this issue would have to be litigated and interpreted by the courts at some point. The President can “decide” under Article 147(3) that his Deputy will act as the President with LIMITED POWERS. What this means is that even when the President is in Kenya (without going out of the country), he can decide,direct,instruct that his Deputy would/to act as the President(but not with full instruments/authority of power). #First I know uhuru has been advised by his lawyers at the Hague that in order to appear humble before the court, it is profitable for him to appear as a private citizen than as a head of state. Despite the fact that Dutch police outriders were already awaiting him. But his Kenyan #Learnedfools cannot grasp this! #Second Ruto was given power but he remains a puppet. Before the announcement, Uhuru met top military men(the once who really rule Kenya) and they promised to keep in check these ODM people (Musalia,William Ruto and Raila). For in Political science, trust is not a virtue. The constitution did not count much, it is for #Learnedfools. #Fourth, Uhuru have saved us of a Diplomatic and Protocol quagmire because it is both illegal for an African head of state to walk without an ADC and it is also illegal for any body not being the accused to be at the accused dock in the court on #cuffs, in the name of providing security to the accused. Are #Learnedfools following? #Fifthly, it is a gimmick to convince the ICC, that Uhuru could not have indirectly perpetrated or lead a campaign of murder, rape, and displacement of population against the Kalenjin because he has after all handed over power to a Kalenjin. #Learnedfools Now my sincere question is Uhuru has been going out of the country several times but he has never appointed the DP as the Acting President,Why did he decide to do so this time round? is Uhuru kenyatta not 100 percent sure of what is awaiting him? Uhuru surely knows very well he can trust Ruto only to an extent(with limits).
