Unfortunately not a good day today for us, we lost the PIP tribunal because the judge and panel seemed to ignore the rest of the evidence and concentrate on the fact that my client has a son with learning difficulties that she cares by providing moral support and encouragement. Although we made it very clear that he is providing her with the physical support they based their decision on the needs he requires from her, and the fact that she goes to the shops local to her to shop every few days for odd items with him. It seems that PIP is not to help you live a better quality of life and to help you afford the extra help you need because of your disability, but its more a case of being so bad that you cannot leave the house without permanent help. Every one we have known that has failed so far lives alone, so ensure that you put how much help you need on the forms and explain in the medical,getting whoever helps you to make a statement saying how much help they give you. PIP really needs a radical overhaul as in my opinion some courts really do not understand the descriptors! On the other side, B has travelled all the way to Stockton on Tees again for the 2nd time only to be told that our clients medical has been cancelled when she got there as he could not confirm he could get down 5 flights of stairs if the fire alarm went off, neither could B. Last time that happened to me I quoted the equality act and also threatened to expose them and publicise their latest trick and the bottom offices were surprisingly opened up for all the assessments within minutes of complaining, sadly that wasnt the case today.
