Universal is asking that I pay for their exorbitant attorneys fees, which is sort of like a robber asking you to pay his medical bill for an injury he sustained while robbing your house. Quick re-cap: I wrote and copyrighted Bright Red Chords in 2008, Universal asked for my song on May 5th 2010, Domino came out in August 2011 and when I sued Universal they got my case successfully thrown out of court before it got a fair trial. I am now appealing that decision. 33 pages of the Judges 35 page decision were about my lack of access to the writers, there was hardly any mention of the VP of Universal A&R Sunny Elle Lee who asked for my song in 2010, and no mention of Sean Walsh who worked to promote my song in 2009 and since 2010 has worked directly with Jessie J and other writers of Domino. The Judge also decided that even though my song had massive national exposure through MTV, Urban Outfitters, Loews Theaters, Footlocker, Fuse TV, Spike, Delta Airlines, and countless radio outlets (among other media outlets) not to mention hundreds of live shows and showcases at industry festivals like SXSW, none of that counted as enough exposure to where a writer of Domino might have heard the song. The fact that my old guitar player Casey Hooper left my band to work with the writers of Domino in 2010? - Also deemed not enough access to the writers by the judge. But the real kicker was Universal successfully convinced the judge that their A&R people never showed my song to their writers. Thats a dangerous precedent, if record companies can do that their A&R department can find songs and their writing department can rip off those songs without any repercussions. Im hopping my appeal can change the law so independent artists are protected against this in the future as I dont think this is the first or last time this will happen. For example Domino writer Dr. Luke already has a long track history of copyright infringement lawsuits, its become a pattern in his career and I dont think its gonna stop anytime soon.
