THIS AGREEMENT made Between His Highness the Sri Paduka Bawah Duli Yang Dipertuan Sultan Hashim Jalilul Alam Akamudin Ibnul Marhom Sri Paduka Maulana Assultan Omar Ali Saifudin who is ruling on the throne of the Kingdom of Brunei and its dependencies and E. W. Birch, Esq., C.M.G., Governor and Commander-in-Chief of the Colony of Labuan and the State of Borneo acting on behalf of the British North Borneo Company. WHEREAS from time to time arms and ammunition have been smuggled into the territory of the British North Borneo Company from the districts lying between Sepitong and the River Trusan. WHEREAS the said districts are under the ruleof His Highness the Sultan of Brunei. WHEREAS trouble has arisen and is likely to arise so long as the said districts are governed as at present. WHEREAS it is for the benefit of His Highness the Sultan of Brunei and the British North Borneo Company that the said districts and the inhabitants should come under the rule of the British North Borneo Company thus relieving His Highness the Sultan of Brunei from all troubles and responsibilities that may arise there. Now WE His Highness the Sri Paduka Bawah Duli Yang Dipertuan Sultan Hasim Jalilu Alam Akamudin by this Agreement cede to the British North Borneo Company, their successors and executors, all the sovereign rights and powers which are within Our right and power, over and in the districts lying between the River Sepitong and Trusan including the rivers Marintaman, Mengalong, Merapok, Lawas, Sari, Puang, Lumut (Siang Siang), Kabak Putus, Palait, Bumbun and Langari together with all the lands, waters, bays, and rivers not herein mentioned lying on the North of Trusan. The British North Borneo Company agrees to respect the rights of the Pangerans and other people who own property in the aforesaid districts, and the concessions made by His Highness the Sultan of Brunei, provided such concessions wereconfirmed and granted by His Highness the Sultan of Brunei prior to the 7th of September, 1901. IT IS FURTHER AGREED that the British North Borneo Company will pay to His Highness Bawah Duli Yang Dipertuan Sultan Hashim Jalilul Alam Akamudin his heirs and successors in perpetuity the sum of six hundred dollars ($600) per annum payable on the 7th of September every year in consideration of His Highness the Sri Paduka Bawah Duli Yang Dipertuan having ceded to the British North Borneo Company the Sovereign rights and other powers in the aforesaid districts and rivers. WE His Highness the Sri Paduka Bawah Duli Yang Dipertuan hereby acknowledge to have received in advance the sum of four thousand eight hundred dollars ($4,800) being eight years payment of the said $600. This Agreement is written in Brunei on the 7th day of September, 1901. WITNESS to above Signature and Seal. (Signed) W.H. HASTINGS, Acting Resident, Labuan
