“Upskirting” ALERT Massachusetts highest court ruled Wednesday that it is NOT illegal to secretly photograph underneath a persons clothing -- a practice known as upskirting.” cnn/2014/03/05/us/massachusetts-upskirt-photography/index.html?hpt=hp_c2 Upskirting is a relatively new term for someone taking a camera and aiming it up a woman’s skirt with the intent of photographing intimate parts of her body. Now common sense should tell you that this activity would be illegal, however as stated by Senator Amanda McGill’s office, “technology is advancing faster than the law.” Unfortunately, as in Massachusetts, our current law does not have the language that would make upskirting a crime. Currently the Nebraska Unlawful Intrusion bill states the following: “It shall be unlawful for any person to knowingly intrude upon any other person without his or her consent or knowledge in a place of solitude or seclusion. “ In essence what this means is, if a woman is in a public place there is no law to protect her from becoming a victim of upskirting. However, Senator McGill has introduced an amendment to the “Unlawful Intrusion” Law, Nebraska Statute 28-311.08. nebraskalegislature.gov/FloorDocs/Current/PDF/Intro/LB1034.pdf Women should become aware of this loophole and familiarize themselves with the amendment that is before the State Legislature. If this amendment is adopted, law enforcement officers across the State of Nebraska would have the ability to make arrests in upskirting cases.
