Verdict of j&k HC given in the case of, Sanjay Tikko V. State and others. is contrary to tenets of Islam, HCBA Describing the verdict of Jammu and Kashmir High Court on “Indianism” as “contrary to the basic tenets of Islam,” the High Court Bar Association (HCBA) has decided to challenge the judgment under Personal Law. In a statement, the lawyers body said that it had convened a meeting of prominent religious scholars, preachers and leaders on Saturday to discuss the matter. “The meeting had been called by the Bar Association to discuss the course of action to be followed in respect of the verdict of the High court in a case titled Sanjay Tikoo versus State and others wherein the court besides other things has held that there is only one “ism” viz “Indianism” which has to survive in India and all other “isms” have to disappear from the firmament of the country called India,” the statement said. The statement said that the meeting, attended by besides all the executive members of the Bar Association, the representatives of Jama’at-i- Islami, Jamaet-i-Ahli Hadees and Ahli Sunnat-wal- Jama’at, discussed the judgment of the court threadbare. “All the participants expressed that the judgment impinges on the rights of the people to profess, propagate and practice their faith and belief freely,” the statement said. “It was also stated that since the judgment of the High court is contrary to the basic Islamic tenets, as such the Bar should immediately file an Appeal against the judgment before the appropriate forum,” the statement added. According to the statement, the representatives of the religious organization who participated in the meeting assured the Bar Association that they will also take up the matter with the heads of their respective organizations and will apprise the people about its fall out very shortly. “In view of the consensus arrived at in the meeting the Bar Association will now file the Appeal before the High Court on the grounds available to it under Personal Law and other laws on the subject,” the statement said.
