Via Samuel Kangethia Maina My take....Lisemwalo lipo kama halipo limo njiani laja International Criminal Court (ICC) Chief Prosecutor, Fatou Bensouda, has finally admitted that she has no witnesses to testify in the case facing President Uhuru Kenyatta at The Hague. In a confidential letter she wrote to Trial Chamber V (b) on Monday, Bensouda said she has tried to beg over 40 witnesses to testify against Uhuru, but all have refused. “Hon Judges, I have a problem with witnesses in Case II (Uhuru Kenyatta’s). Many witnesses have disappeared and recanted their testimonies and it is now elusive for me to prosecute the Kenyan President,” Bensouda wrote. Regarding the financial documents she requested from Kenyatta, Bensouda said the documents she was given by Kenya’s Government did not add any weight in Uhuru Kenyatta’s case. “The documents I requested from the Kenyan Government regarding Uhuru wealth, bank records and phone records were tampered with and I cannot rely on them,” Bensouda wrote to the judges. The Judges however gave Bensouda 14 days to put up her case or they terminate Uhuru’s case on technical grounds.
