The settlement was approved by a 7-1 vote earlier this week, with Councilman Dennis OKeeffe opposed. The lawsuit was filed by a group of day laborers organized under the name Jornaleros de las Palmas, along with the Mexican American Legal Defense and Education Fund. As part of the lawsuit, the fund was seeking $503,633 for attorneys fees and costs. The agreement approved by the council means the city will pay the group about $357,167 for attorneys fees and costs and nearly $15 in interest per day since July 4. The agreement also stipulates that both groups would waive their rights to appeal and would “refrain from engaging in any future public media efforts.” In June, U.S. District Magistrate Judge Stephen Smith found that a portion of the Texas Transportation Code that blocks solicitation on a roadway and the city’s application of it to crack down on day laborers violated the laborers’ First Amendment rights.
