We are all aware that judgements from highest courts are binding to the lower court. Hence how it arrive at a judgement is always guiding the lower ones. A decision based on dubious fact or on doubtful or unsubstantiated evidences, will only set precedent to lower court to follow. Especially in criminal cases where fundamentally very high standard of prove i.e. beyond reasonable, is required for the court to convict a person. Therefore upholding the rule of law is of paramount important. Otherwise real criminal could rely on precedent to get away. It is then needless to say that highest courts should be cautious on its reliance prior making a decision by looking beyond the judgement per se. I really hope see a fair and far sighted judgement. Justice must not only be done but must undoubtedly and manifestly be seen to be done - Lord Denning.
