We are the Monaghans, a family of 8, with 6 beautiful children, Kyler, Kelly, Mallory, Serena, James and Mason, that is being threatened of being ripped apart by CPS due to my husbands vindictive ex wife, Mellissa Alvarado. Mellissa calls CPS on my family every summer during Kyler and Kellys extended standard summer visitation, we have always cooperated fully, allowed them to interview our children time and time again, allowed them into our home over and over, submitted to drug testing, Austin has even admitted to recreational marijuana use and the cases have still been completely ruled out, we have done EVERYTHING theyve ever asked until this July! I refused to cooperate at all on grounds of harassment and have it all on video tape. The case worker, Leslie Allen, called me back after our initial meeting at the gate to tell me she was able to confirm EVERYTHING Id said about the previous cases and vindictive calls made by Mellissa Alvarado every year, and that all had been completely RULED OUT with full cooperation and that shed have to get with her supervisor Linda Juarez, and get back to me about how to proceed with this investigation, but that she needed to come back out and lay eyes on my children, which I allowed her to do, even allowed her to photograph them at our gate. After she left she called me again to tell me that because we have a special needs child in the home even though there is evidence of Mellissas repeated vindictive calls and abuse of the system for custody reasons they have to continue to investigate the cases because special needs children are more vulnerable. I called numerous times for updates about our case, and got the same answer from Leslie every time, shed have to talk to her supervisor. Next she contacted me about setting up a family mediation meeting with Mellissa, I told her shed never agree to such a meeting and she told me shed trick her into it by asking her to come to the office to give a written statement, and that they have to do that sometimes with parents like her that refuse to cooperate. I told her if shed set it up wed be there anything to stop this harassment of our family. Mellissa refused as I told the investigator she would. I continued to call for information and updates about our case through August, always getting the same answer, shed have to talk to her supervisor. Monday, October 6th, investigator Allen, and Officer Rodriguez from Mustang Ridge PD came to my home with a court order to enter my residence and interview my children, shed already been to their school and conducted the interviews earlier that day, I wasnt home at the time but my husband allowed them in and allowed them to search our home for signs of abuse or neglect and drug use, which they found none. After they left he realized the court order used to enter our home had our neighbors address on it not ours! I immediately contacted investigator Allen with my concerns about her unlawful entry into our home and requested her supervisors contact information, which she provided. Tuesday the 7th I began attempting to contact, Supervisor Linda Juarez, after many calls and messages I finally received a call back from Ms. Juarez, at which point I went over all the ways our case had been mishandled by investigator Allen, it was way beyond the 60days they have to come to a resolution, this is October, this case was reported in July, the illegal entry of my home with a court order with someone elses address, the confidential information the investigator gave me, everything. She told me shed be staffing my case and would be getting back to me with an update by Friday, October 10th. Said she couldnt confirm or deny who the reporter was, I told her your case worker Leslie Allen has already confirmed that information as well as that our case is being handled differently because of my special needs child Mallory, she refused to acknowledge that information at all. I called twice Friday and left 2 voicemails for Supervisor Juarez and got no response. I finally called back and asked the Secretary if Ms. Juarez was even in the office at all, we ended up getting disconnected somehow and then I got a call back from Supervisor Juarez immediately. She asked if a drug test had been offered, I replied it was demanded and refused, she said so it was offered, I said again it was demanded and refused, and she said then a judge will have to decide if a drug test is needed to close this case. I asked her then if drug use is considered child abuse in Texas with no other evidence of abuse or neglect of our children, she said they cant determine that without a drug test and wed be getting a summons for court, I asked how if they are using someone elses address, she then asked for our address and I replied weve received several ruled out notices over the years at this same address it should be in the case history, isnt that the first thing a case worker should do is review the families case history and hung up. We attempted legal aid but because they have helped Mellissa in the past its a conflict of interest. We are going to pursue harassment charges against Mellissa for her repeated abuse of the system and vindictive false reports against us every year, and fight CPS for continuing to harass us with these clearly outlandish accusations from an obviously jealous and bitter ex wife. We are going to fight for our rights and our family anyone who knows us or our children know we are not child abusers. Prior to becoming a full time stay at home mom in 2012 I was an early child development professional for over 9 years, I have been reaponsible for caring for children of assistant DAs in Austin Tx, as well as the head of IRS securities children and 100s if not 1000s of others from all walks of life. CPS is under immense scrutiny locally for continuously failing the children and families of Texas and they are at it again with us!! Will you stand with the Monaghans??
