We filed suit on a case yesterday in which our client was a pedestrian whose feet were run over by a motorist who wasnt paying attention as she was driving through a school drop-off lane. Despite the fact that there are witnesses who saw the defendant drive over the yellow line separating the driveway from the pedestrian area at the school, the adjuster told us that she doesnt believe her insured (the defendant) was liable because, we cant make this stuff up, the defendant driver had been dropping off her child at that school for several years, and had never before had an accident there. There you have it folks, if you havent had an accident, you can never have an accident. If you think about it, based on the adjusters logic, no one can ever have an accident.
