We had a similar incident in Cedar Hills about 10 years ago. In short, this raises a lot of interesting questions. Who is,or should be, responsible for deciding a location is safe for development? The city? The developer? The property owner? The engineer that reviews the area? I mean, there will be a land slide on every mountain some time in the next million years, and it can happen any where with the right conditions (like an inch of rain in just a few hours). Also, I have driven through these neighborhoods several times in North Salt Lake, and even in my car I almost felt dizzy at times going up amazingly steep roads with homes all around on the surrounding hills. I guess my only point is this: no one can eliminate all risk. And, if they claim they have, theyre lying. I think the better approach would be to simply require that the Engineer rate a location between 0 and 100 on the risk of a land slide, and the buyer of any home confirm in writing they are aware of the Engineers rating before buying the home. Every home along our beautiful benches here along the Wasatch Front has some risk of a land slide.
