Well, now we move onto part xxx of the Saga of the bathroom renovation. After spending a full day in settlement negotiations on the first of this month with terms of settlement where conman Tim Rae had to pay the first of 3 installments of $5000 by 4pm yesterday (it had to be cleared in the bank and accessible by us by this time). A reminder was sent to him yesterday morning when we saw there was no money in the acc and had a reply that we were never to contact him again. On reply we stated we would pursue ALL further contact with his business addy in Bulleen (his parents address) and that we would take further action by re-lodging with VCAT for the full amount of $15,000 payable immediately as per the terms of settlement if there was a breach. He then claimed that he couldnt pay till next week, we stated it was to be be paid by 4pm, he stated part payment of the first installment, we stated fully payment by the deadline and clearly told him that once we had the certified copy of orders for the $15,000 we would issue bailiffs to sell off his possessions, summons him to the magistrates court for an oral presentation of his finances and if need be, issue a bankruptcy notice on him. He then asked for the bank details again as apparently his terms of settlement document were burnt by a fire (or one of Alistairs colleagues suggested - a dog ate my homework!!!!!). So unless the money is in the account by Monday morning, we are to write an affidavit stating he owes us $15,000 he breached the terms of settlement by failing to pay by the required deadline, we then attend VCAT for orders and then head off to the magistrates court for swearing in of document and then off to work out if we have to go through Bailiffs and summons or straight to bankruptcy. Oh the tangled webs we weave... and he is still yet to be prosecuted and as far as I know, the list of charges keeps getting bigger with other people starting to make complaints against him. :) Happy days ahead for all!!!
