What does the law say about a childs capacity to commit a criminal offence? Basically, a child under the age of 10 cannot be liable for a criminal offence. If the accused was aged between 10 and 14 at the time of the alleged offending, the prosecution must prove beyond reasonable doubt that the accused knew at the time of the offence that his or her conduct was seriously wrongful.
