If a historian wanted to understand the meaning of the United State Constitution, for instance, we would obviously consult sources available to those who wrote the document in 1776 rather than contemporary sources. However, if we abandon this common default rule of interpretation, there are scores of current interpretative theories from which to choose and many others that surely will be advanced by scholars yet unborn. Originalism is thus the only theory that provides a solution to the coordination problem of constitutional interpretation. If our Constitution is a common bond, we need a common way of understanding it and that common understanding can only be provided by the default rule of interpretation that we generally apply to historic documents. Originalism is an ideology or concept applying to the imaginary of interpretation. The concept that every human action by any agent must be felt and this result is measured by the moral interpretation of the cultural habitus occupying that space and time. If an individual has been forced or cajoled into conformity with a conception of the good, then coercion or deception has been driven to the heart of that individual’s self-constitution as a moral being; his life has now no meaning except a coerced or deceived meaning (Marx explains this by the alienation of peoples and their labor). Once this principle is adopted, of course the rational can come on the scene only as a restriction on the type of freedom which this principle involves and then this directs us to “Originalism” as a default in concept theory.
