There is not a 100% fault division in negligence in this case, as is typically the case in all legitimate negligence cases. This case would be roughly 90% Ryan Homes 10% owners for how we handled their negligence. Most of the pictures on the site, (actually all) were taken on the second self destruction of the interior of the home that was caused entirely by builder criminal negligence. Certain people sometimes note that some damages in the pictures could be reduced and better covered up with constant cleaning and maintenance. But on the second self destruction of the home, the damages were deliberately left alone. Why? Because we had already sought legal action to recover tens of thousands of $$$ out of pocket expenses from the first self destruction of the home due to Ryan Homes negligence. Based on prior experience, we changed our approach to recovery. What happened, after the house was mostly recovered from the first damages with a massive and expensive restoration, our lawyer began to become dismissive of our losses, and was clearly not going to help us with any recovery from them. He had lost all our case files and seemingly was too drunk and stupid to handle any lawsuit for anyone. We expected to eat our losses at that point and recover ourselves. When the problems returned in full the next winter, our un-filed legal case became even more relevant. More clear and 100% undefendable, negligence was found against Ryan Homes for damages from construction defects, including low level CO2 poisoning that was documented and verified. On this second home destruction we took photos and collected data to make a clear legal case. We also did NOT immediately proceed to fix all the damages for several reason as happened the time before. Also, when it was a total certainty that the home damages were inherently caused from criminally negligent construction, there was no more partial insurance support on the second destruction event, as occurred on the first event. Second, we were severely in debt over the expenses the insurance company cheated us out of, when they decided to cover only the house smoke and fire damages, but not ANY of the soot destroyed items in the house, which the policy was written to clearly be covered by the policy we paid for. Third, cleaning up all the damages before not only restored most of the house damages and losses, but it seemed to also clean up any proof of liability. So we were determined to NOT again help Ryan Homes get away with more negligence by cleaning up a mess they caused through clearly defined and verified criminal negligence. So, consequently, along with many other lies Ryan Homes told concerned customers who saw our site and the consequences of shoddy construction, the mess visible in the pictures their negligence was left alone, intentionally not cleaned up again until a settlement occurred. But that never happened. Beneficiaries of Ryan Homes/NVR try to claim it was our fault because we stopped cleaning up a mess Ryan Homes caused. The actual conclusion from a mass of cover it up actions by Ryan Homes that is still ongoing by Ryan Homes and continues to prove their desire and plan to get away with criminal negligence, with no concern for victims they created. While some of their people try to claim were just out to make a buck by complaining or victimizing Ryan Homes by using the Internet, the reality has been, weve never made a cent as victims over the last 14 years, while Ryan Homes continues to profit by taking shortcuts in home construction, affecting thousands of others, without ever seriously addressing the consequences of the harm they caused, other than to dismiss it and bury the truth. Unfortunately, the defects progressed to toxic mold, and without needed support for restoration, the home became uninhabitable. The defective home truly became a nightmare home. It has never been recovered.
