Who couldve predicted this trend 20 or especially 30 years ago in the age or Bowers vs. Hardwick and when the Equal Rights Amendment was still an exciting possibility looming on the legal world? Interesting how gays (well, gay men at least and arguably lesbians fulfilling the paterfamilias role, too, I think in Kennedys mind perhaps) remain both of and outside the patriarchy in sort of parapatriarchy replete with a narrative that speaks to the ruggedly individualist male majority on both the left and right poles of the court whereas women--i.e. the underpaid and overworked numerical majority of the population whose legal questions never enjoyed any sort of strict constitutional scrutiny--seem unable to interest the male judges in both their continued plight as second-class workers and semi-children unable to care for their own bodies.
