Will your former employer really give you a bad recommendation? I don’t care how bad of an employee you were- the answer is a resounding NO. Although the law provides a former employer with certain candor inducing protections to allow for the giving of poor assessments, these protections are easily lost. As a consequence, most employers will only confirm dates of employment instead of risking defamation and retaliation claims. Just to show how easily a well-intentioned employer can get it trouble: a Pennsylvania court recently awarded damages to a former employee because his former boss said, “[The employee] didn’t show up to work a couple days last month.”
