YOUNGSTOWN, Ohio (WKBN) – Two high-level employees of a soil remediation company in Lowellville were indicted Thursday on a slew of charges, including open dumping and illegal disposal of drilling fluids. Frank A. Naples, 66, of Poland, plant manager for Soil Remediation, Inc., 6065 Arrel-Smith Road, is facing charges of open dumping of solid wastes, illegal operation of a solid waste landfill without a license, complicity to illegal storage of petroleum contaminated soil, illegal disposal of drilling fluids and illegal disposal of other drilling production waste. The company’s president, David J. Gennaro Sr., 69, of Poland, is facing the same five charges as an individual and in his capacity as president of Soil Remediation, Inc., according to the indictment. The indictment states that Naples and Gennaro “unlawfully and recklessly disposed of solid wastes by open dumping” on 302 separate days between June 26, 2012 and April 23, 2013. It also states that they operated and maintained a solid waste facility without a license between June 26, 2012 and Dec. 4, 2014 for a total of at least 590 days. The indictment states that Naples and Gennaro assisted in the illegal storage of more than two weeks of contaminated soil at the Arrel-Smith Road facility between Feb. 29, 2012 and April 23, 2013. Naples and Gennaro also are accused of discharging brine, crude oil, natural gas or other fluids associated with well production into surface water on 115 separate occasions between June 22, 2012 and Sept. 9, 2012 and Sept. 11, 2012 through Jan. 30, 2013, according to the indictment. They also are accused of improperly handling the disposal of drilling waste between July 2, 2012 and Sept. 8, 2012, and between Sept. 10, 2012 and Jan. 29, 2013, for a total of 102 separate days. wkbn/2014/12/05/lowellville-company-officials-indicted-for-illegal-dumping/
