Yesterdays Senate Public Hearing on BBL, Pinakamalaking Public Hearing na Napuntahan ko from the word of Sen. Marcos. After expressing Our Support to BBL and its Immediate Passage we explained in details to Sen. Bong Bong our specific Concerns on Lake Lanao, we explained to him the Distinctions on the Following Classifications of Lake Lanao in relevance to SBN 2408 or BBL Draft: First, Lake Lanao as part of BM Inland waters which according to BBL is Exclusive this would Imply that there will be no Force entry of Vessels in the Inland waters and the water rights is exclusive to BM but in the other Provisions of the same Bill, if theres Inter Connectivity of Water to other region there is going to be a Coordination and Cooperation among the Concern Government Units, theoretically Inland Water Rights is accorded to a Full Sovereign State not an autonomous one like BM which is still part of the PH. Second, Lake Lanao as Natural resource, in the BBL, Natural resource is exclusive to BM but in several Provisions of the BBL, it detailed the manner of sharing and exploration even in awarding contracts to developer- from this we can say that exploration and utilization of natural resources like Strategic Minerals, the Central Government has the final say but the BM will have its Say and Share of Course, but missing in this is the Manner of Sharing in Utilization of Lakes and Rivers. Third is Lake Lanao as Energy resource in the recent statement from GPH Panel (OPAPP) they acknowledge that there is a distinction on lake Lanao as Inland waters and as an energy resource, this is a Good development so that we can move on with this issue and resolve it the Soonest (Hopefully). We Want to include as one Classification of LL is energy Resource so we can avail of the Sharing and utilization Arrangements provided in the BBL, We also Propose an equitable Sharing meaning 50/50 between the Central Government and the BM Government on the utilization of Lake Lanao by the 6 HEP owned by PSALM but maintained and Operated by NPC. There are those who Opined just to allay our fears and neutralize our Position that the Future BM Government will take care of this, they will Pass BM Laws regarding Lake Lanao, I Just would like to remind this Brothersand Sisters that if we cannot expressly include Specific arrangements or grants for lake Lanao in the BBL--BM Laws cannot supersede PH National Laws, BM Laws are still Subordinate to National Laws much More to the PH Constitution, If we want to resolve this, Now is the time, BBL is the right venue for this Decades old Injustices on Lake Lanao and its Inhabitants, It must be expressly Granted in BBL, Because BBL is a National Law.
