Flanagan President University of Southern Maine 707 Law Building Portland, Maine 04104 Dear President Flanagan: We have not thus far received a response to our letter of November 14, setting forth our concerns relating to the administration’s actions to terminate the appointments of fifty tenured and other long-serving faculty members and to eliminate or consolidate numerous academic programs. The Associations executive director, after reviewing the information available to us concerning the matter, and after conferring with members of the Associations staff, has reached the conclusion that these actions at the University of Southern Maine have raised significant issues of academic freedom, tenure, and due process that are of basic concern to the academic community. In situations of this kind, our experience has indicated that it is desirable, in fairness to the institutional administration, to the affected faculty members, and to the institution as a whole, to establish an ad hoc committee composed of professors from other academic institutions, to conduct its own full inquiry without prejudgment of any kind. The executive director has accordingly authorized the appointment of such a committee to investigate this case. The investigating committee will be provided with relevant available information for its examination and will arrange for a site visit, expected to occur in January, in order to consult in full measure with chief administrative officers, with affected professors, and with such other members of the faculty and the administration as may be designated, in order to ensure that the university will have a full opportunity to present its position. The ad hoc committee will prepare a report for the consideration of the Associations standing Committee A on Academic Freedom and Tenure, which may authorize its publication. Under Association procedures, prior to any publication a draft text is submitted on a confidential basis to the institutions chief administrative officers and to others principally concerned in the report, with an invitation to them to offer corrections of any factual errors and whatever other comments they deem suitable. We shall be writing again soon to inform you of the names of the members of the ad hoc committee and the planned dates for the committees visit. We should like at this time to emphasize the Associations receptivity in this case, as in all others, to resolutions of our concerns that would preclude the necessity for the investigation now authorized.
