ZPO opposes appointment of DSP on backward quota Zeliang People Organisation (ZPO), Nagaland has opposed the appointment of one Withuiliu Zeliang as DSP in Nagaland Police through NPSC in 2011 on the ground that she did not fulfil the requisite criteria of the state government notification for indigenous status in Nagaland and therefore, not entitled to enjoy the benefit of the indigenous Zeliang Tribe of the state. ZPO media cell in a press release stated that Withuiliu Newmai is from “Namtiram Village of Manipur” who was appointed as DSP in 2011 under backward quota reserved for Zeliang Tribe. ZPO asserted that Withuilio is not an indigenous inhabitant of the state and also reminded that many unions, associations, organisations of Zeliang Tribe had voiced their opposition before the government and appropriate forum against the validity of Withuiliu Newmai’s appointment under backward quota ZPO said that following the order of the Gauhati High Court Kohima Bench, the state chief secretary conducted an enquiry and in a report dated September 16 last, opined that the issue be settled by taking a decision on the antecedents of one Damthui Newmai and consequently the indigenous inhabitant status of Withuiliu Newmai. ZPO said the chief secretary maintained that since the issue fell within the realm of customary law, it should be heard and decided in the appropriate customary court which dealt with Liangmai customs and practices. The ZPO has raised objections to the report of the chief secretary in suggesting for settlement of the matter under the Liangmai custom and practices. The ZPO stand was that the Liangmai custom and practices had nothing to do with the issue since the matter was exclusively related to the rules framed by the government of Nagaland on declaration of indigenous tribe status in Nagaland. Further, it pointed out to the notification of the government of Nagaland to the issuance of indigenous inhabitant certificate that read as: “The Governor of Nagaland is pleased to decide that in order to qualify as an Indigenous inhabitant of the state of Nagaland, which was defined in the Govt. Notification No. AR-8/8/76 dated 28.04.1977 which read as “.... that in order to qualify as an “Indigenous Inhabitant” of the state of Nagaland for the purpose of employment as envisaged in the order No. APPTT-16/6/67 dated 6-7-73, a person should have settled permanently in Nagaland prior to 1-12-1963.” ZPO reminded that the criteria for determining a person to have had a permanent settlement in the state prior to December 1, 1963 was that the person’s name or his/her parents or legitimate guardians, in case the person was then a minor, should have been entered in the electoral roll published on December 5, 1963 or his/her parents or legitimate guardian should have been paying house tax prior to December 1. The person or his/her parents or legitimate guardian should have acquired property and patta prior to December 1, 1963, reminded ZPO. ZPO maintained that Withuiliu Newmai was not entitled to enjoy the benefit of the indigenous Zeliang Tribe of Nagaland and therefore, concluded that her appointment as DSP against backward reserved quota for Indigenous Zeliang Tribe of Nagaland was “illegal and not tenable.” -NP
