copy of my email to Nora Patterson As a sound engineer, pro musician and a taxpayer, I submit to you that you dont understand Decibels at all, not in any stretch of the imagination. if you did there would be no way you or any intelligent person would take part in passing an ordinance that is physically impossible to adhere to. The decibel (dB) is a logarithmic unit (NOT LINEAR), meaning that you cannot add and subtract dB like ordinary numbers. For example, an increase of 3 dB is a DOUBLING of the strength of a sound, and an increase of 10 dB means that the sound is 10 times as loud. This means that a 70 dB source is 10 TIMES as loud as a 60 dB source. ALSO KEEP IN MIND THAT there is a big difference between the intensity of sound (measured in watts/m^2) and the loudness of the sound as estimated by a human listening to the sound. Perceived loudness is NOT proportional to the intensity of the sound. In other words, sounds above OR below what you can actually hear will also be measured and displayed on a DbA meter. Nightbirds chirping hits 77 decibels when measured with an A weight. ambient sound from an outdoor cafe with NO MUSIC playing hits 85 dba. I will never pay a single fine and I am encouraging ALL venue owners to contact me before their day in court. I will want proof of calibration and certification of all db meter operators. so unless you want all night time business to cease. you must change the application and decibel level limits in this ordinance. you cannot selectively apply a law, What is applicable for me must be applicable to you as well. There are over 5,000 local musicians that you are harming with this silliness. They pay taxes too, they purchase music equipment and supplies in our area as well, they provide income to waitresses/waiters, bus boys etc etc you have created a problem where none existed before. Bobs boathouse recieved over 40 complaints for noise since it opened and was never found to be in violation of any noise ordinance, so you changed the rules until he was guilty of something? Shameful! I submit to you that many of those 40 plus complaints were from the same person, and that constitues harassment in anyones book! You (or they as the case may be) may not like Bobs boathouse, I dont like the KKK but they are free to assemble and hold Rallies. My fan page has over 14,000 people on it, my personal page has over three thousand, and in less than a weeks time a new page was started called the live music alliance and it already has over 1600 people on it, including lawyers. we have support from city council memebers across the state AND from across the country. If you think all this internet stuff is inconsequential, then I believe that speaks directly to your lack of understanding your residents and modern technology. we are in the right here. I understand that a compromise needs to be reached. But putting so many of us out of work is not the answer. To wrap this up. In short, if you fine me, be prepared to fine landscapers, if you fine a venue be prepared to fine people laughing or snezzing after 10:00 pm. Ambrish piares, (Owner of Ivory lounge) Lawsuit against the condo association will only be the beginning. Also calling what we the musicians in this City of the arts do. NOISE is insulting and defamatory. Being labeled as such hurts our employability in other locations. This will be brought up in a class action lawsuit should it become necessary.
