despite the position in protocol, after speaking to a couple of eminent Senior Advocates of Supreme Court im now clear that it was wrong on the part of Justice Sathasivam to accept the Governorship of Kerala. P.P.Rao told me to read his book which was released last year, in which one entire topic is exactly on this_ Judges as Governors. incidentally the book was released by none other than Chief Justice Sathasivam.ive bought a copy of that book Reclaiming the Vision and am reading it. Rao says it is not a good idea. T.R.Andhyarujina said it is not at all a good idea. not because he was former CJI, but any Judge should not accept it. Raju Ramachandran was of the opinion that it is wrong for the former CJI to accept any post except that of NHRC Chairman, Vice President or President. his opposition is mainly due to the fact that the position of Governor is on the pleasure of the President and can be removed at any time. he says earlier Fazal Ali and Fatima Beevi both Judges of the Supreme Court had accepted it. while Fazal Alis appointment came in 1952 even before he demitting the office of Judge of the Supreme Court and it was widely criticised at that time itself though the Constitution was in the formative years. according to him in the present day situation, Sathasivam ought not to have accepted this post. he says, Fatima Beevi was dismissed by previous NDA regime and asked do you want Sathasivam in the same position?. he says, it is a different thing that Ranganatha Misra had become an MP. it is an elected post. he says he has given his opinion to Tribune and will say the same thing wherever it is required. the only one lawyer who partly agreed to the appointment is Dr.Rajeev Dhavan. he said, there is nothing wrong in the appointment, provided the Judge had not met the Prime Minister, Minister etc. before leaving the office. ill try to elicit the opinion of K.K.Venugopal also and will share it here.
