from THE CONSTITUTION (ONE HUNDRED AND TWENTIETH AMENDMENT) BILL, 2013 passed by Rajya Sabha (only one member Ram Jethmalani dissenting) "3. After article 124 of the Constitution, the following article shall be inserted, namely:— "124A. (1) There shall be a Commission to be known as the Judicial Appointments Commission. (2) Parliament may, by law, provide for— (a) the composition of the Commission; (b) the appointment, qualifications, conditions of service and tenure of office of the Chairperson and other members of the Commission; (c) the functions of the Commission; ..................................................................." this is where many jurists have an apprehension that tomorrow the composition of the Judicial Appointments Commission can be altered very easily by an amendment to the Act (not a Constitutional Amendment) ___considering the manner in which Govt is trying to dilute the Civil Liability for Nuclear Damages Act, 2010 by an Executive action bypassing the Parliament, the fear is not unfounded. only hope is that such an amendment can be struck down if it violates basic structure
