the education act amended in 2012 disallows appointment of any person to the post of teachers if he or she is not TET qualified. the stated that the jurisdiction of the act is also applicable in the sixth schedule areas like BTAD or the KAAC. justice chutia in his order, also mentioned that although the sixth schedule administration is empowered to assign jobs to the primary teachers in the primary schools functioning under its jurisdiction, the national education statute is desired to be uniform in the country, and the amended education act of 2012 will remain equivalent and unchanged in case of sixth scheduled areas.
