the funny thing about Padillas case is that the original presidential decree involving unlicensed firearm was draconian. the penalty was severe. congress then passed a law lowering it and because it was stupidly or brilliantly crafted, it created a loophole which allowed the offender to plead guilty to the lesser offense with the charge of illegal possession being absorbed. then after Padilla benefitted from the law, congress then passed a new law, to remove the loophole and raising the penalties once again. our tax money at work.
