សេចក្តីថ្លែងការណ៍ STATEMENT សមាគមរោងចក្រកាត់ដេរនៅកម្ពុជា សូមថ្លែងអំណរគុណយ៉ាងជ្រាល ជ្រៅ និងសូមធ្វើការវាយតម្លៃខ្ពស់ចំពោះចំណាត់ការរបស់អាជ្ញាធររាជរដ្ឋា ភិបាល ជាពិសេសកងរាជអាវុធហត្ថខេត្តកំពង់ស្ពឺក្នុងប្រតិបត្តិការចុះ បង្រ្កាបចោរលួចសម្លៀកបំពាក់ពីក្នុងកុងតឺន័រកាលពីថ្ងៃសុក្រ ទី២៣ ខែមករា កន្លងទៅ។ ផលិតផលសម្លៀកបំពាក់សម្រេចទាំងនោះត្រូវបាន ផលិតក្នុងរោងចក្រនៅប្រទេសកម្ពុជា ហើយសំដៅនាំចេញទៅកាន់ទី ផ្សារបរទេស។ The Garment Manufacturers Association in Cambodia (GMAC) would like to express our sincere thanks and high appreciation toward actions of the government’s authorities, especially the Kampong Speu Military Police in their operation to crack down on the case of container theft last Friday 23 January. Those finished garments had been produced in Cambodia and were bounce for overseas market. សមាជិករបស់សមាគមជារឿយៗបានជួបនឹងបញ្ហាបទឧក្រិដ្ឋដែលមាន លក្ខណៈជាប្រព័ន្ធនេះ ហើយបានធ្វើការអំពាវនាវជាផ្លូវការឲ្យរាជរដ្ឋា ភិបាលយកចិត្តទុកដាក់បង្រ្កាបចាប់តាំងពីឆ្នាំ២០០៨មកម្លេះ។ Members of GMAC occasionally face this problem of syndicated crime and had officially called for the government’s attention since 2008. បញ្ហានេះជារឿងធ្ងន់ធ្ងរមួយដែលទាមទារនូវការលុបបំបាត់ឲ្យខាងតែបាន ពីព្រោះវាមិនត្រឹមតែធ្វើឲ្យមានការខាតបង់ដល់រោងចក្រផលិតប៉ុណ្ណោះទេ ប៉ុន្តែថែមទាំងបានធ្វើឲ្យអ្នកបញ្ជាទិញដែលជាម៉ាកល្បីៗមួយចំនួនបាត់ទំនុកចិត្តក្នុងការដាក់ការផលិតនៅកម្ពុជា ដោយសារកម្មសិទ្ធិបញ្ញារបស់ ពួកគេមិនត្រូវបានការពារពេញលេញ។ តួយ៉ាង គេសង្កេតឃើញមាន ផលិតផលសម្លៀកដែលទើបច្នៃម៉ូដថ្មីៗ ត្រូវបានចោរលួចនិងដាក់លក់ យ៉ាងបើកចំហក្នុងប្រទេសកម្ពុជាដូចជានៅផ្សារទួលទំពូងជាដើម។ ជាលទ្ធផលជាក់ស្តែង បញ្ហាដ៏អកុសលនេះបានជំរុញឲ្យម៉ាកល្បីមួយ របស់អាមេរិកបញ្ឈប់ការផលិតទាំងស្រុងពីកម្ពុជាកាលពីប៉ុន្មានឆ្នាំកន្លង ទៅនេះ។ This is a serious issue requiring total abolishment because it does not only cost the manufacturing factories, but also leads to the loss of confidence among some brand buyers in placing production orders in Cambodia when their intellectual property rights are not fully protected. Practically, one can see newly designed garments are stolen and sold openly in Cambodia such as at Toul Tompoung Market. As a result, this unfortunate issue led one American buyer to totally stop production in Cambodia last few years. ការទិញនិងការលក់សម្លៀកបំពាក់ដែលត្រូវបានលួចចេញពីរោងចក្រគឺជាអំពើឧក្រិដ្ឋ ហើយត្រូវផ្តន្ទាទោសធ្ងន់ធរតាមច្បាប់ព្រហ្មទណ្ឌ។ ការទិញនិងការលក់សម្លៀកបំពាក់ដែលមានម៉ាកផ្សេងៗដោយមិនមានការអនុញ្ញាតត្រឹមត្រូវពីម្ចាស់ម៉ាកគឺជាការរំលោភបំពានលើកម្មសិទ្ធិបញ្ញា ហើយត្រូវផ្តន្ទាទោសតាមច្បាប់ស្តីពីកម្មសិទ្ធិបញ្ញា។ Buying and selling stolen garments is a criminal act and shall be severely punished under the criminal code. Buying and selling garments bearing brand names without proper authorization is an infringement of their intellectual property rights and shall be severely punished under the intellectual property law. សមាគមសូមលើកទឹកចិត្តដល់រាជរដ្ឋាភិបាល និងអាជ្ញាធរគ្រប់លំដាប់ ថ្នាក់ឲ្យបន្តការបង្ក្រាបប្រឆាំងនឹងសកម្មភាពឧក្រិដ្ឋដែលមានលក្ខណៈជាប្រព័ន្ធនេះឲ្យកាន់តែមានប្រសិទ្ធភាពថែមទៀត ដើម្បស្តារនូវទំនុកចិត្ត របស់អ្នកវិនិយោគនិងអ្នកបញ្ជាទិញ។ GMAC encourage the government and concerned authorities at all level to continue to crack down against this syndicated criminal activity in a more effective manner to restore confidence of both investors and buyers. រាជធានីភ្នំពេញ ថ្ងៃទី២៧ ខែមករា ឆ្នាំ២០១៥ Phnom Penh, January 27, 2015
