A manufacturer of ginger ale can be liable to a consumer in negligence even if there was no direct contractual relationship with the manufacturer if she fell sick on finding a snail in a bottle of ginger ale made by that manufacturer. Coca-cola cannot be liable if a cockroach was found in a bottle of their coke. Come on ... Its the law in Donoghue v Stevenson ... This is 101 on law of negligence. There was neither ginger ale nor a snail, just ordinary coke and a freaking cockroach!
