AB 2488 Will Allow Wine Sampling at Farmers Markets Following the passage and signing of AB 2488 wineries selling at farmers markets may sample their wine. We have begun hearing from market operators about a dramatic increase in the number of applications from wineries interested in selling at farmers markets. Operators of Certified Farmers Markets and wineries should be aware of certain restrictions: Wineries must grow the grapes and bottle the wine themselves in order to sell it at a certified farmers market. Wineries are limited to a maximum of 5,000 total gallons in total wine sales annually, across all certified farmers market they participate in. Market operators have the authority to allow or prohibit wine sampling at their discretion. The sampling area must be separated from the rest of the market by a wall, rope or other permanent or temporary barrier. Wineries may not pour more than 3 total ounces per customer. Only one winery may conduct sampling on any given market day.
